{"id":85,"date":"2026-01-26T13:18:48","date_gmt":"2026-01-26T21:18:48","guid":{"rendered":"https:\/\/sonix.ai\/resources\/?p=85"},"modified":"2026-02-01T15:57:25","modified_gmt":"2026-02-01T23:57:25","slug":"a-simple-guide-to-understanding-the-american-with-disabilities-act-ada","status":"publish","type":"post","link":"https:\/\/sonix.ai\/resources\/a-simple-guide-to-understanding-the-american-with-disabilities-act-ada\/","title":{"rendered":"A simple guide to understanding the American with Disabilities Act (ADA)"},"content":{"rendered":"<h2 style=\"margin-top: 20px;\" id=\"what-is-the-americans-with-disabilities-act-ada\"><b>What is the Americans with Disabilities Act (ADA)?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The <a href=\"https:\/\/www.ada.gov\/\">Americans with Disabilities Act (ADA)<\/a> was signed into law in 1990. <\/span><span style=\"font-weight: 400;\">The ADA is a civil rights law that prohibits discrimination against individuals with disabilities in all areas of public life, including jobs, schools, and transportation.<\/span><span style=\"font-weight: 400;\"> It prevents discrimination against a group that has historically faced many barriers. <\/span><\/p>\n<h2 id=\"why-does-the-ada-matter\"><b>Why does the ADA matter?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The ADA matters for any business because the law states that it is illegal to provide good or services to the public that are not also accessible to people who have d<\/span><span style=\"font-weight: 400;\">isabilities. Not only that, there are over 60 million Americans with disabilities.<\/span><\/p>\n<h2 id=\"who-does-it-impact\"><b>Who does it impact?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The ADA impacts any business or government that is providing goods or services to the public. It is one of the most far-reaching pieces of legislation that the US has enacted. However<\/span><span style=\"font-weight: 400;\">, what is defined as accessible isn&#8217;t always clear cut so there can be some grey areas.<\/span><\/p>\n<h2 id=\"how-does-the-ada-handle-websites-and-web-accessibility\"><b>How does the ADA handle websites and web accessibility?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Currently the ADA does not explicitly address web accessibility. It has generally been up to lawyers to assess how the ADA applies to websites and online content. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Having said that, the ADA is enforced by the U.S. Department of Justice (DOJ). And the DOJ has issued a Supplemental Advanced Notice of Proposed Rulemaking (SANPRM) to incorporate web accessibility into the ADA standards. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The DOJ\u2019s public position was clarified in the following statement made during the Netflix case:<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">\u201cThe Department is currently developing regulations specifically addressing the accessibility of goods and services offered via the web by entities covered by the ADA. The fact that the regulatory process is not yet complete in no way indicates that web services are not already covered by title III.\u201d<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">These ADA guidelines for web access will continue to change over time and prevailing wisdom is that the ADA extends to online content.<\/span><\/p>\n<h2 id=\"what-happens-if-im-not-compliant-with-the-ada\"><b>What happens if I\u2019m not compliant with the ADA?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Most complaints related to the ADA are generated by individuals with disabilities, their families or disability-rights organizations. There are times when the DOJ initiates an investigation but it is not common. If you receive an ADA related complaint to your organization you may get sued. It\u2019s best to talk to your lawyer. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">It should also be noted that the ADA does not have a team of inspectors. It is up to businesses and governments to comply with its requirements proactively.<\/span><\/p>\n<h2 id=\"whats-the-best-way-for-podcasters-to-be-ada-compliant\"><b>What\u2019s the best way for Podcasters to be ADA compliant?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">If you are a podcaster or you create audio lectures, you should provide a transcript of the words being said. The transcript should be accessible online or by download. <\/span><\/p>\n<h2 id=\"whats-the-best-way-for-video-producers-to-be-ada-compliant\"><b>What\u2019s the best way for video producers to be ADA compliant?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">If your business creates videos those videos should have closed captions. Captions should be time-synced to the speech. You should also make sure you are using a media player that can be controlled by the keyboard.<\/span><\/p>\n<h2 id=\"what-is-the-least-expensive-and-easiest-way-to-make-my-website-ada-compliant\"><b>What is the least expensive and easiest way to make my website ADA compliant?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Creating transcripts and captions manually is the least expensive way but not the easiest.
